I found this article on AppleInsider interesting, given that OakTree has already implemented it with the auto-hide feature for the instant details box. We Accordance users are on the bleeding edge of technology, using ideas Apple hadn't even come up with yet!

It looks to me like the patent is about making windows translucent under particular conditions so that you can read both, whereas what Accordance does it make a window appear and disappear under certain conditions. Not quite the same thing.

True, unless you call the Accordance implementation "rapid translucency." So rapid, it becomes invisible.
While they are not exactly identical, the premise is very similar to the instant details box auto-hide feature.
