Can't keep Highlighters palette separately (as in v.9)

I love highlighting texts! But in v. 10 it's more complicate than in v. 9. In v. 9 I had highlighter palette always open and I could drag it anywhere, then I could press Command+Option+3 to open or close it and it would always appear in the same place. In v. 10 I can detach highlighter palette, but if I close it, it opens again in the toolbar. Could you please alter this behavior so that if I detach it, it stays detached regardless if I close it or not. As I have a button to detach it, it could have button to reattach it.

By the way, when I detach highlighter palette, it has a small visual glitch:
